What is ESIGN Day?

The Electronic Signatures in Global and National Commerce Act, often known as the “Millennium Digital Commerce Act” or the “E-SIGN bill,” was signed into law 22 years ago by President Bill Clinton on June 30, 2000. The ESIGN Act, which supplements any state-created legislation, equalizes electronic and digital signatures with traditional paper – or wet signatures. According to the law, a signature’s legal effect cannot be disputed because it is in electronic form.

National ESIGN Day reminded Congress that anything could be accomplished electronically, even during a brutal economic downturn. In most cases, a digital signature is deemed as valid and legal as a print signature, and eSign continues to be widely accepted by US banking. While the most prevalent approach to eSign has been from an individual perspective, with each person signing their documents, the success of this method has led to the development of eSign for corporate document validation.

  2. More than 40 states had previously passed legislation governing electronic signatures when the bill was passed, but the regulations were not uniform.
  3. Jim McDermott (D-WA) supported the declaration of June 30 as “National ESIGN Day” in June 2010.
  4. A contract or signature “may not be denied legal effect, validity, or enforceability only because it is in electronic form,” according to Section 101 of the act. Although the statute allows for electronic signatures, the individual retains the ability to choose whether or not to do so. They may decide to sign documents on paper rather than using an electronic signature. E.g., Wills, adoptions, divorces, utility cancellations, insurance cancellations, court orders, and official court documents.
